Before using ListPod.net, please carefully read this agreement relating to your use of this site. If you do not agree with these terms, do not use this site. By accessing this site or any of its services, you agree to be bound by these terms.
Portions of these terms of service may be changed, modified, added to or removed at any time. Such changes will take effect immediately unless otherwise noted.
Registration Obligations
In order to submit or rate content on ListPod.net, you must first agree to these conditions.
- You must be at least 13 years of age.
- You may not post content that is obscene, offensive, vulgar, or racist in nature.
- You may not select a username of another person with the intent of impersonating that person or entity without prior authorization of that person or entity.
- You man not select a username that is a name subject to the rights of another person or entity without prior authorization.
- You may not select a username that is obscene, offensive, vulgar, or racist in nature.
ListPod.net reserves the right to temporarily or permanently ban any user accounts that do not meet these criteria, that violate any other terms in this document, or for any other reason. User registration data is handled in accordance with the site’s privacy policy.
User Conduct
By using ListPod.net, you agree to not use this site for any purpose that is unlawful or prohibited by these terms. In addition, you must not use this site/service:
- To abuse, harass, impersonate, intimidate, harass or threaten any other users of the site.
- To post or transmit any content that is infringing, libelous, defamatory, abusive, indecent, lewd, pornographic, obscene, offensive, vulgar, or in violation of any law or right of a third party.
- To perform any other illegal or unauthorized purpose. International users must agree to comply with all local laws regarding acceptable content.
- To violate laws in your own jurisdiction, including but not limited to copyright law.
- To create or transmit unsolicited or unwanted content or email (spam).
- To artificially inflate, deflate, or otherwise alter the rating of any list or item. This includes but is not
limited to:
- Creating multiple user accounts to submit more than one rating.
- Giving or receiving money or other compensation in exchange for ratings.
- Impersonate or attempt to impersonate any other person or entity.
- Transfer your profile to another person or entity.
Any user accounts or content may be removed at any time, without notice or reason.
Content
All content (defined as information, data, text, software, images, audio, video, and any other material), is the sole responsibility of the user from which such content originated. All user-submitted content is the responsibility of the user that submitted such content and not ListPod.net. Due to the nature of this user submitted content, ListPod.net cannot and does not guarantee the accuracy, integrity, or quality of said content. Under no circumstances will ListPod.net be held liable for user-submitted content.
By submitting content to ListPod.net, you warrant that you either own such content or the content is licensed in such a way that allows posting on ListPod.net. Any user-submitted content that does not clearly state a license agreement (or cite a source that states a license agreement for the content) shall be subject to the Creative Commons BSD License, available at http://creativecommons.org/licenses/BSD/. In addition you must grant ListPod.net an irrevocable, non-exclusive, perpetual, royalty-free, transferable license to adapt, create distributive works from, distribute, display, modify, perform, publish, reproduce, transform, and otherwise use such content (in whole or part) and/or incorporate it in other works in any form, including by means of any technology not yet known or developed, all subject to the terms of any applicable license.
ListPod.net respects the intellectual property rights of others and therefore, we will remove or take other appropriate actions against any content that we believe infringes on such rights.
Indemnity, Limitation of Liability, and other Disclaimers
You hereby agree to indemnify and hold harmless ListPod.net, affiliates, and their respective officers, agents, and employees from any and all damages, demands, claims, costs, and liabilities, including attorney’s fees made by any third part due to or arising out of that party’s acts or omissions.
ListPod.net is provided on an "as is" and "as available" basis. Use of this site is provided at the sole risk of the user. No warranty exists and ListPod.net expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The services provided by this site, or the site as a whole may be suspended or terminated at any time without notice.
ListPod.net, our affiliates, users, or any other third party may provide links to other websites. ListPod.net exercises no control whatsoever over such other websites and we cannot and shall not be held responsible or liable for the availability, content, advertising, or any other materials of such sites; and shall not be held responsible for any damage or loss incurred from such.
